When selling or purchasing a property, conveyancing is needed for the process of exchanging ownership of that property.
It involves several steps including completing all legal documents, researching the property for any issues such as easements or covenants as well as ensuring everything is in order for settlement.
Whilst both conveyancers and solicitors have the ability to do the job, it is important to differentiate what each can provide.
One difference between Conveyancers and Solicitors, is that Solicitors are legal professionals. This means that whilst both professionals do have cross-over tasks, Solicitors have extensive experience and knowledge of the law which is beneficial to the buyer or seller for complex property transactions that may have more risk.
Solicitors are also able to provide Contract of Sale reviews. This allows one of our Solicitors to inform the client of any intricacies or Special Conditions in the Contract that the client may not be aware of. A Solicitor can then advise the client if the contract would be favourable to them and/or protect their interests as a Vendor or Purchaser. This is especially common for off-the-plan purchases or subdivisions which often have extremely complex contracts. In this instance, it is essential that a Solicitor is able to review the contract to ensure that both the purchaser's and vendor’s interests are protected.
The law is constantly changing. Amendments to such legislation may be critical in transferring property. Solicitors are always up to date with the newest legislation and are able to act accordingly. This allows them to offer advice on issues outside the scope of a regular conveyancing transaction.
